1. Controller and Scope of Application

The controller for data processing in connection with the registration, licensing, customer portal and support of CatalogHub is:

This Privacy Policy describes what personal data we collect, how we use it and what rights you have.

1.1 Scope of Application and Applicable Law (GDPR)

We offer our Software worldwide. For data subjects located in the European Union (EU) or the European Economic Area (EEA), the EU General Data Protection Regulation (GDPR) applies in addition. Insofar as the Swiss Data Protection Act (DSG) provides for stricter or deviating provisions, the DSG shall apply. Otherwise, the provisions of both laws apply side by side, insofar as they are compatible with the respective territorial scope.

2. What Data We Collect

We collect and process the following personal data:

• Registration Data: Name, email address, company name, role/function (if provided).

• Licence and Subscription Data: Via Keyforge, information about your booked modules (DDEX, CWR), subscription status, term, cancellations as well as your access data for the customer portal are processed.

• Payment Data: When you take out a paid subscription, your payment data (e.g. credit card information, PayPal account) is transmitted directly to PayPal or Stripe. We ourselves do not store any sensitive payment data, only a reference to the payment (e.g. transaction ID, last digits of the card, billing address).

• Communication Data: If you contact us by email, we store the content of this communication.

2.1 No Collection of SFTP/FTP Access Data

The Software offers the option to store SFTP/FTP access data (server, username, password, port) locally on your computer (provided you activate the corresponding checkbox). This data is not transmitted to Battl Victory Records. There is no encryption; the security of this data is your responsibility. We have no access to this data whatsoever.

3. Purposes of Processing and Legal Bases

We process your data for the following purposes:

• Provision of the Software and the customer portal (contract performance)

• Management of your registration and subscription (contract performance)

• Sending update notifications by email (legitimate interest)

• Processing support requests (contract performance or legitimate interest)

• Processing payments via PayPal and Stripe (contract performance)

• Fulfilment of statutory retention obligations (e.g. accounting)

Legal bases under DSG/GDPR:

• DSG: Necessity for contract performance or legitimate interest.

• GDPR: Art. 6 para. 1 lit. b (contract performance) and lit. f (legitimate interest).

4. Disclosure of Your Data to Third-Party Providers

We only pass on your data to the following processors who support us in providing our services:

No disclosure for advertising purposes.

5. International Data Transfers (GDPR Compliance)

Your data is primarily processed in Switzerland (adequacy decision by the EU Commission). For transfers to the USA or other third countries by Keyforge, PayPal or Stripe, we rely on Standard Contractual Clauses of the EU Commission as well as additional technical and organisational measures. You may request a copy of these safeguards from us.

6. Retention Periods

• Registration Data: As long as your account is active. After deletion or 12 months of inactivity, we delete them, unless statutory retention obligations (e.g. Swiss Code of Obligations Art. 957 – 10 years) prevail.

• Subscription Data: For the duration of the subscription plus 3 years for handling queries.

• Payment Data: We only store billing references; complete payment data remains with PayPal/Stripe in accordance with their policies.

7. Your Rights under DSG and GDPR

Under Swiss DSG, you have the rights to information, rectification, deletion, restriction, objection and data portability.

In addition, as a data subject in the EU, you have the following rights under the GDPR:

• Right to be forgotten (Art. 17 GDPR)

• Right to restriction of processing (Art. 18 GDPR)

• Right to data portability (Art. 20 GDPR)

• Right to object (Art. 21 GDPR)

• Right to lodge a complaint with a supervisory authority (Art. 77 GDPR)

8. Security

We implement appropriate technical and organisational measures to protect your data against loss, misuse or unauthorised access. Communication with the customer portal and our servers is encrypted (TLS).

Please note: Local storage of SFTP/FTP access data on your computer is unencrypted if you activate the checkbox. This is your responsibility.

9. Amendments to this Privacy Policy

We may amend this Privacy Policy from time to time. The current version is available on our website and in the customer portal. In the event of material changes, we will inform registered users by email.
